Service Description

Mediation Preparation is designed to ensure you approach mediation with clarity, structure, and a well-defined position. Mediation is often a critical point in a matter. The outcome can shape the direction of negotiations, and in many cases, determine whether court proceedings can be avoided. Proper preparation is essential. This service focuses on understanding your current position, identifying the key issues to be addressed, and developing a clear and considered approach to negotiations. We work through the practical and strategic aspects of your matter so that you are not entering mediation without direction. We consider the range of possible outcomes, your priorities, and how your position may be presented in a way that supports effective negotiation. Following this process, you will be better prepared to participate in mediation with confidence, clarity, and a structured approach. What this service includes • Review of relevant information and material • A strategy session focused on mediation preparation (typically 60–90 minutes) • Identification of key issues for negotiation • Discussion of potential outcomes and parameters • Guidance on how to approach and respond during mediation What this service does not include • Attendance at mediation • Ongoing negotiation or communication with the other party • Drafting of formal offers or agreements (unless separately agreed) • Ongoing representation Any further work will require a separate costs agreement. Ideal client This service is suited to you if you have a mediation scheduled or anticipated and want to ensure you are properly prepared before attending.


Cancellation Policy

Mediation Preparation is provided on a fixed-fee basis. The fee includes review of relevant information provided prior to the session, a strategy consultation focused on mediation preparation, and a post-session summary. The service is limited to the scope described. It does not include attendance at mediation, ongoing negotiation, communication with the other party or their representatives, or drafting of formal offers or agreements unless otherwise agreed in writing. Payment is required at the time of booking. The fee is not held in trust and is treated as payment for a defined legal service. If additional work is required beyond the scope of this service, a separate costs agreement will be provided and agreed prior to any further work being undertaken. Booking this service creates a limited scope solicitor-client relationship for the purpose of Mediation Preparation only. No ongoing retainer is created unless otherwise agreed in writing. The guidance provided is based on the information available at the time. No guarantee is given as to the outcome of any mediation or negotiation. Appointments may be rescheduled with a minimum of 24 hours’ notice. Requests to reschedule within 24 hours may not be accommodated. Cancellations within 24 hours of the scheduled session may result in forfeiture of the booking fee. If you fail to attend the scheduled session without prior notice, the booking fee may be forfeited. To enable adequate preparation, any relevant documents or information should be provided at least 24 hours prior to the scheduled session. Material provided after this time may not be reviewed in advance.
